Re: CRIMINAL REFERRAL – Potential Violations of 18 U.S.C. § 1001, 18 U.S.C. § 111, 40 U.S.C. § 5104 (three counts), and 18 U.S.C. § 1512(c)(2) (two counts) by Former Metropolitan Police Department Officer Michael Fanone
Dear Acting Attorney General Blanche:
I respectfully submit this criminal referral requesting that the Department of Justice initiate a full and expedited investigation into material false statements and additional criminal violations by former D.C. Metropolitan Police Department Officer Michael Fanone.
Material False Statements to Congress – 18 U.S.C. § 1001
On July 27, 2021, Officer Fanone provided sworn testimony before the House Select Committee to Investigate the January 6th Attack on the United States Capitol as part of the hearing “The Law Enforcement Experience on January 6th,” alongside Sgt. Aquilino Gonell, Officer Daniel Hodges, and Pfc. Harry Dunn.
A key material representation in his testimony was that he “had been beaten, unconscious and remained so for more than four minutes.” This was presented as resulting from severe physical assault. However, Mr. Fanone’s own body-worn camera footage and supporting evidence demonstrate that if there was any period of iwas brief rather than prolonged unconsciousness caused by extended severe physical trauma as portrayed in the sworn testimony. This misrepresentation was material to the Committee’s investigation.
Additional Potential Violations Supported by Video Evidence
In addition to the material false statements detailed above, video evidence posted on X https://x.com/IvanRaiklin/status/2016260848797319202/video/1 depicts three separate incidents (“rounds”) of confrontational conduct by Michael Fanone on or about September 27, 2022; February 23, 2025; and January 22, 2026. Additionally, here
is the CSPAN footage of this incident where former MPDC Officer Fanone appears to assault a U.S. Capitol Police Officer attempting to escort Mr. Fanone as ranking member Representative Jaime Raskin soothes Jack Smith’s VIP guest Fanone from a tourrett’s spell. Note, Jaime Raskin previously was the lead impeachment manager for the second Trump impeachment and subsequently served on the J6 committee, the same committee that Mr. Fanone allegedly made materially false statements in violation of 18USC1001.
This evidence supports investigation and prosecution of the following additional violations:
- Violations of 18 U.S.C. § 111 (Assaulting, resisting, or impeding certain officers or employees)
- Three (3) counts of violations of 40 U.S.C. § 5104 (Unlawful activities in Capitol grounds and buildings)
- Two (2) counts of violations of 18 U.S.C. § 1512(c)(2) (Obstruction of an official proceeding)
These incidents include physical approach, verbal threats, and interference in settings that appear to include Capitol grounds and official proceedings, as clearly depicted in the video compilation. The video itself contains on-screen text referencing 18 U.S.C. § 111 and 40 U.S.C. § 5104 in connection with Round 3.
STATUTE OF LIMITATIONS URGENCY
The material false statements were made during sworn testimony on July 27, 2021. The applicable five-year statute of limitations for violations of 18 U.S.C. § 1001 will expire on or about July 27, 2026. It is imperative that charges be investigated, referred, and brought before this deadline. Any delay risks the permanent loss of the ability to hold the witness accountable.
Requested Action
I therefore formally request that the Department of Justice:
1. Immediately open a full investigation into the false statements matter, including obtaining all relevant body-worn camera footage, the complete hearing transcript and video record, and all medical records of Officer Fanone.
2. Determine whether probable cause exists to believe that violations of 18 U.S.C. § 1001 occurred.
3. If warranted, refer the matter for direct prosecution to the United States Attorney for the District of Columbia, the Honorable Jeanine Pirro, or pursue federal charges directly through the Criminal Division.
4. Act with all deliberate speed given the rapidly approaching statute of limitations deadline of July 27, 2026.
5. Investigate concurrently the additional potential violations of 18 U.S.C. § 111, 40 U.S.C. § 5104 (three counts), and 18 U.S.C. § 1512(c)(2) (two counts) supported by the video evidence posted at https://x.com/IvanRaiklin/status/2016260848797319202/video/1, and refer any appropriate charges for prosecution.
I am prepared to provide additional evidence, detailed analysis, or sworn testimony to assist in this investigation at any time.
This referral is submitted in the interest of accountability and the rule of law. False statements to Congress and the additional violations shown on video cannot be tolerated.
